General Terms and Conditions

  • 1 General

SECONDELLA GmbH & Co. KG, Hohe Bleichen 5, 20354 Hamburg, Managing Directors Marie-Louise Schaernack, Silke Griebel, Brigitte Kasper, phone number: +49-40-35 29 31, shop@secondella.de (hereinafter referred to as „secondella.de“ or „we“), operates through a website with the Internet address www.secondella.de thus giving the opportunity to buy the indicated goods per e-mail or to place orders by phone. The general terms and conditions specified in the text to follow shall apply to all orders made through this website and to our deliveries and services in the form applicable at the time of placing your order. Deviating terms and conditions of the customer shall not be recognised by us unless we have agreed to their validity in writing.

  • 2 Right of return

You may return the received goods without the need to specify the reasons by sending us the goods back within two weeks. This period commences at the moment of receipt of this instruction in written form (e.g. as a letter, fax, E-mail), but still not before the recipient has received the goods. The timely sending the goods back or the return request is sufficient for the compliance with this deadline. The costs of sending back the goods shall be borne by the customer. Consequences of Return
In case of an effective return the mutually received services have to be refunded and use that has possibly been made of the goods (e. g. advantages by use) has to be returned. In case of deterioration of the goods, reimbursement may be claimed. This shall not apply in cases when deterioration of the goods is the result solely of the check – as it would have been possible for you in a retail shop, for instance. In addition, you can avoid the obligation to replace the value by not becoming an owner of the goods and by refraining from any actions that could affect the value of the goods, such as, in particular, the removal of the labels. Obligations to reimburse payments must be fulfilled within 30 days. This period shall for you commence with the shipment of the goods or the return request and for us with the receipt.

  • 3 Important Information

The goods offered on secondella.de are represented on the Internet site with digital photographs of real goods. Slight deviations between the representation and the actual item do not represent any defect to the goods. 2. We point out that the products presented at secondella.de might be not available or procurable any longer at the time of the customer’s visit to the Internet site. The specified prices are all given in Euros, excluded from the shipping costs. The value added tax cannot be shown because we are selling the goods on consignment. 3. Gift vouchers are valid for three years from date of purchase and shall not be reimbursed.

  • 4 Conclusion of a Contract

Conclusion of a contract between you and secondella.de takes place as soon as the advance payment of the ordered goods is made by bank transfer to our account. Once the money is received, the goods shall be mailed to you. 2. secondella.de is entitled to decline an offer you have made without specifying any reasons, in particular because we are commission agents.

  • 5 Delivery & Shipping

The shipping is carried out mainly via UPS and DHL. The risks associated with the shipping shall be assumed by secondella.de. We make shipments within the eurozone. 2. The goods are ready for shipment at the latest on the next day upon the receipt of the money paid. Unless otherwise agreed upon, the delivery shall take place within the period between one and four working days to the delivery address submitted by the customer, depending on the selection of the mode of shipment and place of delivery. Please have in mind that DHL Express Shipment does not deliver on Saturdays within Germany. 3. Shipping costs At the moment, the costs of transportation amount to (since April 2013) € 6.90 for an insured postal parcel (insurance value is € 500.00). In case of higher transport insurance costs or shipment outside Germany, additional costs may be incurred that shall be agreed upon with the customer per E-mail before the conclusion of a contract.

  • 6 Payment, Default in Payment

You can pay the order you have made at secondella.de by advance payment / bank transfer, credit card debit or gift voucher. All payments and credit notes are handled exclusively in Euros. Advance Payment Procedure / Bank Transfer 1. In the confirmation E-mail sent to you after placing your order, you shall receive our bank information and the order number. Note: Credit notes from returns will be transferred back to your bank account.

  • 8 Willingness of cooperation in a settlement of disputes procedure without restriction:

SECONDELLA agrees to participate in a settlement of disputes procedure at a consumer conciliation committee.  

  • 9 Warranty

The statutory provisions on warranty shall apply.

  • 10 Data Privacy

We take data privacy very seriously. All customer data will be stored and processed by SECONDELLA exclusively in accordance with the relevant data protection laws. In particular, the personal data are collected, stored and used solely for the purpose of processing an order, or in accordance with your explicit consent. In addition, address and order details are collected, processed and used for our own marketing purposes. We do not store personal data any longer than absolutely necessary. 2. You may dissent to use, processing and forwarding of your personal data for marketing purposes at any time by sending an informal message by post, by fax or per an E-mail to shop@secondella.de. However, this does not apply to the data necessary to process your order. Upon receipt of your dissent we shall not use, process or forward the data in question for any other purposes except for the processing of your order and we shall also discontinue sending the advertising material to you. 3. We shall not forward the personal data to any third party. Exceptions thereto are the service partners of secondella.de who need the transmission of data for the purpose of order processing. In these cases, the amount of forwarded data is limited only to the minimum necessary.

  • 11 Governing Law, Validity

The law of the Federal Republic of Germany shall apply under exclusion of the UN Purchase Law. 2. Should one or several provisions be invalid, the validity of the remaining provisions shall not be affected therewith.
